These Terms & Conditions govern use of the Symbyote Systems website and orders placed directly with Symbyote Technologies LLP for Symbyote Systems products. Please read them before using the website or placing an order.
Symbyote Systems motor controllers are specialised components for DIY, prototype, racing, off-road and custom electric-vehicle integration. They are not complete vehicles, primary safety systems or certified automotive control units unless a specific product document expressly states otherwise. Selection, installation, configuration, testing and operation are undertaken by the customer or system integrator at their own risk and responsibility.
Symbyote Systems is a product brand of Symbyote Technologies LLP, India (“Symbyote”, “Symbyote Systems”, “we”, “us” or “our” in these Terms). These Terms apply to direct website use and direct orders accepted by Symbyote Technologies LLP. Products purchased from an authorised independent dealer may also be subject to that dealer’s sale terms and local legal obligations.
By using the website, placing an order or submitting an order request, you agree to these Terms and the policies incorporated into them. If you do not agree, do not place an order or use the website in a manner that requires acceptance. You must have legal capacity to enter the transaction. Where you act for a company, racing team, workshop or other organisation, you confirm that you are authorised to act for it.
Symbyote Systems motor controllers and related products are specialised electrical and electronic components intended for integration into electric vehicle and motor-control systems. Correct selection, installation and configuration require consideration of battery voltage, maximum full-charge voltage, battery and BMS capability, motor characteristics, sensors, wiring, connectors, communication, cooling and duty cycle. The customer, builder or system integrator is responsible for verifying that the selected product is suitable for the complete system before installation and operation.
We aim to keep product descriptions, specifications, photographs and compatibility information accurate and current. Technical products may be revised during normal engineering and production development. Changes may be made that do not materially reduce the stated function, or where required for reliability, component availability or manufacturing improvement.
Where exact specifications are critical, contact Symbyote Systems before ordering and rely on the confirmed documentation applicable to the ordered model and revision. Website images may show optional parts, development units, accessories or examples not included unless expressly stated.
Find My Controller, the controller finder and other selection tools assist with initial product selection. Recommendations depend on the information entered and do not replace complete engineering review of the battery, motor, wiring, protection, cooling and vehicle system. A recommendation is not a guarantee of suitability for every installation or duty cycle. Customers must provide accurate technical information. Symbyote Systems is not responsible for selection error caused by incomplete, incorrect or misleading customer information.
Submitting an order or payment does not necessarily mean that the order has been finally accepted. An order is accepted when Symbyote Systems confirms acceptance, begins fulfilment, or otherwise communicates that it will be supplied. We may contact the customer for technical, payment, address, export or order-verification information before accepting or dispatching an order. We may refuse or cancel an order before fulfilment where reasonably necessary because of:
Where we cancel an accepted paid order before supply and no alternative is agreed, the applicable refund will be processed.
Product prices are shown in the currency stated on the website, quotation or checkout. Taxes, duties, shipping, payment charges or other costs may be shown separately or may apply depending on destination and agreed shipping terms. The customer is responsible for reviewing the final order amount and currency before payment. Payment must be made using an accepted method. Reasonable payment or fraud verification may be performed before dispatch. Payment-provider authorisation does not require fulfilment of an order that has not been accepted.
International orders may be subject to customs duties, import taxes, brokerage charges, clearance fees or other destination-country charges. Unless expressly included in the order, quotation, invoice or confirmed shipping term, they are the customer’s responsibility. Specific DDP or other arrangements apply only where expressly confirmed for the applicable order.
Shipping, dispatch, customs, tracking, delivery estimates, failed delivery and transit-damage matters are governed by the Symbyote Systems Shipping Policy. Delivery estimates are not guaranteed unless a guaranteed service is expressly confirmed. Customers must provide accurate delivery information and respond to reasonable carrier or customs requests.
Symbyote Systems does not offer a general voluntary change-of-mind return programme. Order cancellations, incorrect product selection, incorrect shipments, transit damage, unauthorised returns and approved refunds are governed by the Returns, Cancellations & Refunds Policy. A suspected controller fault is handled through the Limited Hardware Warranty and is not treated as a normal return.
Eligible motor controllers are covered by the applicable Symbyote Systems Limited Hardware Warranty. The warranty explains period, covered defects, exclusions, fault verification, regional support and replacement process. The commercial warranty does not exclude rights or remedies that cannot legally be waived.
The customer, installer, vehicle builder or system integrator is responsible for correct installation and complete system validation. This includes, as applicable:
Technical guidance from Symbyote Systems does not transfer responsibility for the complete vehicle or system.
Symbyote Systems controllers use a VESC-compatible configuration, tuning and monitoring workflow where stated. Symbyote Systems is independent and is not manufactured by or officially endorsed by the VESC Project. Third-party software, firmware, applications or tools may have separate licences, terms and limitations. Customers are responsible for using supported versions and safe settings. Damage caused by unsupported modifications or operation outside published limits may not be covered.
Third-party vehicle, motor and brand names may be used only to describe compatibility, fitment or intended application. Unless expressly stated, use of a name does not imply affiliation, sponsorship, approval or endorsement. All third-party trademarks remain the property of their respective owners.
Some products are intended for high-performance, racing, prototype or custom EV applications. Performance figures depend on the complete system, including battery voltage/current capability, motor, gearing, cooling, mass and configuration. No power, current or application statement guarantees specific speed, acceleration, race result or legal road-use status. Customers are responsible for applicable vehicle, competition, road-use and safety requirements.
High-voltage and high-current systems can cause serious injury, fire, equipment damage or death if incorrectly designed, installed or operated. Installation and service should be performed by a person with suitable competence. Follow product documentation and use correctly rated protection, wiring, connectors, isolation and cooling. Do not operate visibly damaged products or systems with suspected serious electrical faults.
Symbyote Systems motor controllers are supplied as individual electronic components for integration into a larger vehicle or machine. They are not a complete vehicle, complete propulsion system, primary braking system or fail-safe safety controller.
Unless expressly confirmed in the applicable product documentation, the products are not represented as homologated, type-approved, road-legal, OEM automotive-certified, ASIL-rated, ISO 26262-compliant, FMVSS-certified, UNECE-approved or approved for any other safety-critical automotive standard.
The customer acknowledges that a high-power motor controller, an incorrect installation, an unsafe configuration or a component failure may cause unexpected torque, sudden loss of propulsion, loss of regenerative braking, wheel lock or overspeed, electrical arcing, battery or wiring damage, thermal events, fire, property damage, serious injury or death.
The customer, builder and system integrator accept responsibility for the complete system and must independently provide and validate appropriate safety measures, including:
The customer must not rely on the controller as the sole means of braking, emergency isolation, overspeed protection or prevention of unintended motion.
To the maximum extent permitted by applicable law, the customer assumes the risks arising from product selection, system design, installation, configuration, tuning, testing and operation. Symbyote Technologies LLP is not responsible for damage to the vehicle, battery, BMS, motor, drivetrain, wiring, charger, connected equipment, other property or third-party equipment where that damage results from integration, installation, configuration, misuse, operation outside published limits, external component failure or use of the product in an uncertified vehicle or safety-critical application.
Purchase, installation or use of a Symbyote Systems product constitutes acknowledgement that the customer has read this notice and accepts responsibility for determining whether the product and the completed system are safe, lawful and suitable for the intended application.
The Symbyote Systems name, website content, product photographs, graphics, documentation, original diagrams, branding and other Company-created material are owned by or licensed to Symbyote Technologies LLP, except where third-party rights are identified. Product documentation may be used for legitimate installation, evaluation, service or use of an authorised product. It may not be copied, republished, sold, misrepresented or commercially exploited in a manner suggesting an unauthorised relationship.
You must not use the website to commit fraud, provide materially false order information, attempt unauthorised access, introduce malicious code, interfere with operation, systematically extract protected content for unauthorised commercial use, impersonate Symbyote Systems or an authorised dealer, or violate applicable law.
The website may identify authorised dealers, distributors or regional warranty partners. Dealer status may change; customers should use current information published or confirmed by Symbyote Systems. Authorised dealers are independent businesses unless expressly stated otherwise. They may have separate local sale terms but may not change the official Symbyote Systems commercial warranty unless specifically authorised.
Orders are subject to applicable export, customs, sanctions and destination restrictions. Symbyote Systems may refuse, hold or cancel an order where supply or shipment would violate law, export policy, carrier restrictions or government requirements. Customers must not provide false destination, end-user or shipment information.
We aim to keep the website available and accurate, but access may be interrupted for maintenance, technical faults, security work or other operational reasons. Typographical, technical, pricing or content errors may be corrected. Where an error materially affects an unfulfilled order, we may confirm a corrected order or cancel and refund the affected order.
To the maximum extent permitted by applicable law, Symbyote Technologies LLP is not liable for damage to a customer vehicle, battery, BMS, motor, drivetrain, wiring, charger, connected equipment, tools, premises or other property arising from product selection, installation, integration, configuration, testing, tuning, operation, misuse, external component failure or failure to implement appropriate independent safety systems.
To the maximum extent permitted by law, Symbyote Technologies LLP is also not liable for indirect, incidental, special, exemplary or consequential loss, including loss of use, vehicle downtime, loss of revenue, loss of profit, loss of opportunity, loss of data, race entry costs or loss of race participation.
For any claim that may lawfully be limited, the aggregate liability of Symbyote Technologies LLP relating to the affected product shall not exceed the amount actually paid for that product or, at the Company’s option, the repair or replacement remedy provided under the applicable Limited Hardware Warranty.
These limitations do not exclude or limit liability for fraud, wilful misconduct, death or personal injury caused by negligence where such liability cannot be excluded, a safety-related defect or recall obligation, mandatory product-liability obligations, or any consumer right or other liability that applicable law does not permit the parties to exclude or limit. The existence of this limitation does not reduce the remedies expressly provided under the Symbyote Systems Limited Hardware Warranty for a verified covered manufacturing defect.
To the extent permitted by law, a business customer, commercial integrator or reseller is responsible for losses or third-party claims directly caused by its unauthorised modification, false product representation, unlawful resale conduct or installation performed in material disregard of published limits. This does not remove consumer rights or transfer responsibility for a genuine manufacturing defect.
Symbyote Systems is not responsible for delay or failure caused by events outside reasonable control, including natural disasters, war, civil disturbance, government restrictions, carrier disruption, customs action, major supply interruption, cyber incidents, power or communication failures, or similar events. Reasonable steps will be taken to communicate material order impacts and available options where required.
Personal information is handled in accordance with the Symbyote Systems Privacy Policy. Relevant customer, order and technical support information may be shared with payment providers, carriers, service providers or authorised regional warranty partners where necessary to process an order, deliver a product or provide support.
These Terms may be updated to reflect product, website, operational or legal changes. The version displayed at the time of an accepted direct order will normally apply, except where a later change must apply by law or the parties expressly agree otherwise.
If a provision is found invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
A delay or failure to enforce a provision does not automatically waive the right to enforce it later.
These Terms and direct orders accepted by Symbyote Technologies LLP are governed by the laws of India, subject to mandatory consumer rights and jurisdiction rules that may apply in the customer’s location. The parties should first attempt to resolve disputes through Symbyote Systems Support.
